Terms of Service

The agreement between you and mmSMTP for our hosting, SMTP, email, domain, and server services — including our acceptable-use and anti-fraud rules.

Last updated: 7 November 2026

1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of the services provided by mmSMTP ("mmSMTP", "we", "us", "our") through mmsmtp.com. By ordering, accessing, or using any of our services, you agree to these Terms, our Privacy Policy, our Acceptable Use rules, and our Refund Policy. If you do not agree, do not use our services.

2. Description of services

We provide crypto-friendly email and hosting infrastructure, which may include SMTP and bulk-email sending, webmail, shared and WordPress hosting, reseller hosting, VPS, dedicated and RDP servers, DNS, SSL certificates, domain registration, and related products. Service features, specifications, and limits are described at the point of sale and may be updated over time.

3. Your account

You must provide accurate, current information and keep it up to date. You are responsible for all activity under your account and for keeping your login credentials confidential. You must be of legal age and capable of entering into a binding contract. Notify us immediately at [email protected] if you suspect unauthorised use of your account.

4. Acceptable Use

You may use our services only for lawful purposes and in line with these Terms. You must not use our network to store, host, transmit, or distribute anything illegal, infringing, or harmful, and you must not disrupt or attempt to gain unauthorised access to our systems, our other customers, or any third party.

Zero tolerance for fraud and scams. We strictly prohibit using any mmSMTP service to carry out, support, or facilitate fraud or scams of any kind. This includes, without limitation: phishing or spoofing pages and credential-harvesting sites; fake, fraudulent, or deceptive online shops; advance-fee, investment, "get-rich", cryptocurrency, romance, lottery, prize, inheritance, and job or employment scams; carding, trafficking in or use of stolen or unauthorised payment cards or financial accounts; identity theft or impersonation; pirated, counterfeit, or otherwise unlawfully distributed goods or content; and sending phishing, scam, fraudulent, deceptive, or malicious email through our SMTP or email services. Accounts found engaging in any of this are suspended or terminated immediately and without refund, and may be reported to law enforcement, relevant authorities, and payment and blockchain networks. We cooperate with lawful investigations.

SMTP and bulk-email rules. If you use our SMTP or bulk-email services, you must follow email best practices and anti-spam law:

  • No unsolicited bulk email (spam). You may only email recipients who have given you clear, verifiable permission to contact them.
  • Opt-in only. Mailing lists must be built on genuine opt-in consent. Purchased, scraped, rented, or harvested lists are prohibited.
  • Honour unsubscribes. Every message must include a working unsubscribe mechanism, and you must process opt-out requests promptly.
  • Accurate headers. Sender names, "from" addresses, and subject lines must be truthful and not misleading or spoofed.
  • Respect plan limits. Stay within the sending volume, rate, and recipient limits of your plan; do not attempt to evade limits or filters.

Violating these rules — or generating excessive spam complaints, bounces, or blocklistings — may result in throttling, suspension, or termination to protect our network's deliverability and reputation.

5. Fees, payment, and renewals

Services are prepaid. Fees are due in advance for the billing cycle you select, and your service is provisioned or renewed once payment is confirmed. We accept cryptocurrency and your payment is credited after the required network confirmations. You are responsible for any network/transaction fees and for sending the correct amount; underpayments may delay provisioning. Prices may change, but changes will not affect the term you have already paid for. If an invoice is not paid by its due date, services may be suspended and then terminated.

6. Refunds

Refund eligibility, the money-back window, and non-refundable items are described in our Refund Policy, which forms part of these Terms.

7. Suspension & termination

We may suspend or terminate your service, with or without notice, if you breach these Terms or our Acceptable Use rules, fail to pay, or create a risk to our network, our customers, or others. Fraud, abuse, and illegal activity may result in immediate termination without refund. You may cancel your service at any time through the client area; cancellation stops future renewals but does not create a right to a refund except as stated in the Refund Policy.

8. Backups (customer responsibility)

You are responsible for maintaining your own backups of your data, websites, email, and configurations. Any backup service we provide is offered as a convenience and courtesy only, is not guaranteed, and must not be relied on as your sole copy. We are not responsible for lost data. Keep an independent, up-to-date backup at all times.

9. Domains

Domain registrations and renewals are subject to the rules of ICANN and the relevant registry and registrar, in addition to these Terms. You are responsible for providing accurate registrant information and for renewing domains on time. Domain fees are non-refundable once a registration, renewal, or transfer is submitted. We are not responsible for registry decisions, disputes, or expirations outside our control.

10. Service availability

We work hard to keep services online and aim for 99.9% network uptime, excluding scheduled maintenance and factors beyond our reasonable control (such as force majeure, upstream provider or network failures, DDoS attacks, or your own actions or software). Uptime commitments, where offered, are described in the relevant plan and any applicable service-level terms. Occasional maintenance and downtime may occur.

11. Limitation of liability

To the maximum extent permitted by law, our services are provided "as is" and "as available" without warranties of any kind. mmSMTP is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the services is limited to the amount you paid us for the specific service in the three (3) months before the event giving rise to the claim.

12. Indemnity

You agree to indemnify and hold harmless mmSMTP and its operators from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the services, your content, or your breach of these Terms or applicable law.

13. Governing law

These Terms are governed by applicable law. Any disputes will be resolved in accordance with the laws and courts of the jurisdiction in which mmSMTP operates. Nothing in these Terms limits any rights you may have that cannot be waived under the law that applies to you.

14. Changes to these terms

We may update these Terms from time to time. We will revise the "Last updated" date above, and significant changes may be announced through the client area or by email. Continuing to use our services after an update means you accept the revised Terms.
